Анотація
У науковій статті автор провів наукове дослідження визначення поняття та змісту понять «децентралізація» та «місцева публічна влада». На підставі проведеного дослідження, автор дійшов висновку, що децентралізація публічної влади – це принцип здійснення публічної влади, це метод публічного управління, це власне процес змін у публічному управлінні, коли переважна більшість повноважень переходить від загальнодержавних органів публічної влади до місцевих органів влади та органів місцевого самоврядування (органів публічної місцевої влади). Найчастіше до змісту поняття «децентралізація» відноситься саме адміністративна децентралізація, тобто перерозподіл повноважень, відповідальності та державних ресурсів між органами публічної влади для більш ефективного надання публічних послуг. Публічна місцева влада у правовій доктрині визначається як легітимне, визнане та гарантоване державою публічно-самоврядне волевиявлення територіальної громади, органів і посадових осіб місцевого самоврядування щодо здійснення їх функцій і повноважень, спрямованих на реалізацію прав і свобод людини і громадянина та вирішення питань місцевого значення шляхом прийняття і реалізації правових актів в порядку, передбаченому Конституцією і законами України, а також нормативними актами місцевого самоврядування. Також у науковій статті визначені загальні та спеціальні риси публічної місцевої влади.
In the scientific article, the author conducted a scientific study of the definition and content of the concepts “decentralization” and “local public authority”. On the basis of the conducted research, the author came to the conclusion that decentralization of public power is the principle of exercising public power, it is a method of public management, it is actually a process of changes in public management, when the vast majority of powers are transferred from state-wide bodies of public power to local and local authorities self-government (public local authorities). Most often, the concept of “decentralization” refers to administrative decentralization, i.e. redistribution of powers, responsibilities and state resources between public authorities for more efficient provision of public services. Public local government in the legal doctrine is defined as a legitimate, recognized and guaranteed by the state public self-governing expression of the will of the territorial community, bodies and officials of local self-government regarding the implementation of their functions and powers aimed at realizing the rights and freedoms of man and citizen and solving issues of local importance by adopting and implementation of legal acts in accordance with the procedure provided by the Constitution and laws of Ukraine, as well as normative acts of local self-government. Public administrative power is characterized by general features of public power such as: public and institutional character; legitimacy; separation of the government apparatus from the population; unification of subordinates on a territorial basis; generality; continuity of functioning; versatility; the binding nature of government decisions for all subjects in the relevant territory; functioning in legal forms; the right to establish and collect mandatory taxes and fees from the population; independent formation of the budget. The primary carrier of local public power is the territorial community, such power extends only to the territory of administrative-territorial units and concerns only matters of local importance, the material and financial base of its bodies is communal (municipal) property and the local (municipal) budget, the system of its bodies lacks strict hierarchy and subordination, the law-making activity of public local authorities has a sub-legal nature.
