Анотація
У статті досліджено проблему особливостей природи та сутності правового забезпечення підвищення рівня банківської безпеки України в особливий період. Запропоновано для мінімізації більшості проблем, що значно знижують існуючий рівень банківської безпеки держави та для забезпечення можливості банківської системи фінансувати відновлення та відбудову економіки України активно працювати з непрацюючими кредитами, що були видані банками раніше, особливо до початку 2022 року; знизити рівень впливу державних банків на банківський сектор у цілому; провести реальну оптимізацію до норм законодавства Європейського Союзу; розвивати внутрішні фінансові ринки
The article examines the problem of the peculiarities of the nature and essence of legal support for increasing the level of banking security of Ukraine in a special period. It is proposed to minimize most of the problems that significantly reduce the existing level of banking security of the state and to ensure the ability of the banking system to finance the recovery and reconstruction of the economy of Ukraine to actively work with non-performing loans that were issued by banks earlier, especially until the beginning of 2022; to reduce the level of influence of state banks on the banking sector as a whole; to carry out real optimization to the norms of the legislation of the European Union; to develop internal financial markets. Considering that the strengthening of the banking sector and the development of a well-functioning capital market will be extremely important for the successful recovery of Ukraine, we believe that certain preparatory steps can and should be taken now. In the process of rebuilding the state, the banking sector will act as a leading element of the entire financial sector of our country. Before the war, the financial sector of Ukraine was underdeveloped and largely based on banks. The country’s traumatic experience during the transition from a planned to a market economy, combined with weak institutions and significant inequality, held back the development of financial markets. The formation of a market-type economy necessitated the creation of a reliable and financially stable banking sector against the influence of external and internal threats in conditions of increased macroeconomic instability. Ensuring the financial stability of banks was one of the ways to solve this problem. The practical role of the banking system was determined by its participation in the management of the payment and settlement system, investments and credit operations, which allowed banks, together with other financial intermediaries, to accumulate the savings of all subjects of the financial market. Even before the beginning of 2022, there were a number of problems in the banking sector, some of which had been accumulating for even more than 10 years. Today, Ukraine is a candidate country for joining the EU and seeks to become a member as soon as possible. Alignment with EU regulatory and institutional norms can provide important economic benefits even before accession. As international donors assist Ukraine in post-war reconstruction, it is critical to ensure predictability of donor income and gradually rely on commercial solutions to create a vibrant financial capital market in Ukraine after the reconstruction period. The deepening of Ukraine’s banking sector will require the privatization of most of the main state-owned banks, which will account for an even larger share of all banking assets after the war. That is, recent reforms and a general overview of the dynamics of the banking sector do not give grounds for significant pessimism. The National Bank of Ukraine and the banks managed to avoid a possible catastrophe in extremely difficult conditions of the external environment
