dc.description.abstractСтаття присвячена дослідженню поняття принципів конституційного контролю як специфічного виду державно-правової діяльності та розкриттю змісту основних принципів організації та здійснення такого контролю, виходячи з його завдань у сфері встановлення, підтримання, зміцнення і відновлення конституційного порядку та забезпечення верховенства конституції держави. Визначено, що системоутворююче значення мають принципи верховенства права та законності, які є базисом правової регламентації суспільних відносин як у сфері державного контролю загалом, так і конституційного контролю зокрема. The article is devoted to studying the notion of the principles of constitutional control as a specific type of State legal activity and disclosing the content of the basic principles of the organization and implementation of such control, based on its objectives in establishing, maintaining, strengthening and restoring the constitutional order and ensuring the supremacy of the State constitution. The authors determine principles of constitutional control as the key ideas, initial principles of organization and implementation of activities of state bodies, with special competence to review, identify, ascertain and eliminate inconsistencies to the constitution of laws, other normative acts, as well as actions (inactivity) of public authorities, organizations or communities associations, on the official interpretation, other powers that ensure the improvement, effectiveness and efficiency of such activities. It has been suggested that the bodies of constitutional control are empowered with significant authority for monitoring the formation of a single legal space and are systemic and comprehensive in nature. However, for this purpose it is necessary to develop such rules (principles) of functioning of the institution of constitutional control, the implementation of which will lead to the increase of its effectiveness. Characterizing the principles of constitutional control as a type of state control, the authors proceeded from a general understanding of the principles of state control and took into account the features that are inherent in constitutional control as a separate type of state-legal activity. Therefore, the authors include to the principles of constitutional control separate general principles of state control, which reproduce the principles of control regardless of the sphere of state and legal activity, such as the principle of rule of law, legality, publicity, efficiency and special principles that reflect the features of constitutional control as a type of state control: the principle of independence of exercising constitutional control, the principle of impartiality, the principle of mandatory and finality of results of constitutional control, the principle of scientific nature. It is determined that the principles of the rule of law and legality, which are the basis for the legal regulation of public relations both in the sphere of state control in general and constitutional control in particular, are of systemic importance.
