Анотація
У статті проаналізовано правову природу Конституційного Суду України, визначено особливості цього органу, які відрізняють його від судів системи судоустрою, а також визначено місце Конституційного Суду в системі поділу влади в Україні.
Характеризуючи співвідношення правового статусу Конституційного Суду України та судів системи судоустрою, автори визначили такі відмінні риси: спеціальна система законодавства, що регулює порядок діяльності Конституційного Суду, відмінність у формуванні між судами системи судоустрою та Конституційним Судом, відмінності у процесуальних формах здійснення повноважень, різна предметна компетенція, відмінності в юридичній природі актів Конституційного Суду України та судів системи судоустрою.
На підставі аналізу особливостей правової природи Конституційного Суду України визначено, що цей орган, організаційно і функціонально не входячи ні в одну з гілок влади, є гарантом ефективного функціонування системи поділу влади. Він знаходиться у сфері забезпечення державної організації в цілому, будучи органом держави, який, здійснюючи конституційний контроль, забезпечує реалізацію державної влади.
Акцентується увага на тому, що для того, щоб ефективно реалізовувати функцію конституційного контролю і бути тим гарантом забезпечення балансу влади, Конституційний Суд України повинен знаходитися поза політичним впливом, його політична функція може і повинна здійснюватися тільки у формі конституційного контролю. Саме в цьому випадку позиція Конституційного Суду як органу, який здійснює державний контроль за станом конституційної законності, має правове значення і юридичні наслідки, обов'язкові для учасників конституційно-правових відносин. Незалежність Конституційного Суду України від сфери політики є однією із ключових передумов забезпечення верховенства Конституції України та реального поділу влади
The article analyzes the legal nature of the Constitutional Court of Ukraine, outlines the features of this body that distinguish it from the courts of the judiciary, and identifies the place of the Constitutional Court in the system of separation of powers in Ukraine. Characterizing the relationship between the legal status of the Constitutional Court of Ukraine and the courts of the judiciary, the authors identified the following distinctive features: special system of legislation governing the Constitutional Court, differences in the formation of the judiciary and the Constitutional Court, differences in procedural forms of powers, different subject competence , differences in the legal nature of acts of the Constitutional Court of Ukraine and courts of the judicial system. Based on the analysis of the peculiarities of the legal nature of the Constitutional Court of Ukraine, it is determined that this body, organizationally and functionally is not included in any of the branches of government, is the guarantor of the effective functioning of the system of separation of powers. It is in the sphere of ensuring the state organization as a whole, being a body of the state, which, exercising constitutional control, ensures the implementation of state power. Emphasis is placed on the fact that in order to effectively implement the function of constitutional control and to be the guarantor of the balance of power, the Constitutional Court of Ukraine must be outside political influence, its political function can and should be exercised only in the form of constitutional control. In this case the position of the Constitutional Court as a body that exercises state control over the state of constitutional legality has legal significance and legal consequences that are binding on the participants in constitutional and legal relations. The independence of the Constitutional Court of Ukraine from the sphere of politics is one of the key preconditions for ensuring the supremacy of the Constitution of Ukraine and the real separation of powers
