In the process of research, the essence of intellectual property as an object of public management was determined, the features of its formation, use and circulation of rights in the national innovation system were revealed. Foreign experience in the functioning of mechanisms of public management of intellectual property was analyzed, which allowed us to establish key trends in the development of this area, in particular, strengthening the role of universities and research institutions, the development of technology transfer infrastructure, as well as the integration of intellectual property rights into the processes of commercialization of innovations. It was established that the effectiveness of management in this area largely depends on the decentralization of management decisions, the development of regional innovation systems, the availability of appropriate infrastructure and wellestablished interaction between public authorities, the scientific and educational environment and business. It is proven that in the conditions of digitalization, the transformation of the regulatory and legal mechanism of public management of intellectual property is taking place, which is manifested in the expansion of the range of objects of legal protection, changes in the forms of circulation of rights, the complication of institutional relationships and the need to adapt legal regulation to new digital realities. The directions of improving the innovative mechanism of public management in the sphere of circulation of rights to intellectual property results, which involve a combination of regulatory and legal, organizational, financial and institutional instruments, are substantiated.
dc.description.abstractДіана ГУРНА. Механізми публічного управління інтелектуальною власністю в Україні. – Магістерська робота. У процесі дослідження визначено сутність інтелектуальної власності як об’єкта публічного управління, розкрито особливості її формування, використання та обігу прав у національній інноваційній системі. Проаналізовано зарубіжний досвід функціонування механізмів публічного управління інтелектуальною власністю, що дозволило встановити ключові тенденції розвитку цієї сфери, зокрема посилення ролі університетів і науководослідних установ, розвиток інфраструктури трансферу технологій, а також інтеграцію прав інтелектуальної власності у процеси комерціалізації інновацій. Встановлено, що ефективність управління у цій сфері значною мірою залежить від децентралізації управлінських рішень, розвитку регіональних інноваційних систем, наявності відповідної інфраструктури та налагодженої взаємодії між органами публічної влади, науково-освітнім середовищем і бізнесом. Доведено, що в умовах цифровізації відбувається трансформація нормативно-правового механізму публічного управління інтелектуальною власністю, яка проявляється у розширенні кола об’єктів правової охорони, зміні форм обігу прав, ускладненні інституційних взаємозв’язків та необхідності адаптації правового регулювання до нових цифрових реалій. Обґрунтовано напрями удосконалення інноваційного механізму публічного управління у сфері обігу прав на результати інтелектуальної власності, що передбачають поєднання нормативно-правових, організаційних, фінансових та інституційних інструментів.
