| dc.description.abstract | З’ясовано співвідношення понять “незмінність рішення суду” та “законна сила рішення суду”, доведено, що незмінність рішення суду входить в зміст законної сили рішення суду, виділено перелік виключень із принципу незмінності рішення суду, та розглянуті особливості набуття властивості незмінності окремими рішеннями суду. Також розглянута проблема неврегульованості порядку виправлення арифметичних помилок або описок у судовому наказі та надані науково обґрунтовані пропозиції щодо її подолання. In the scientific article the author researches the correlation of notions “the invariability of the judicial decision” and “the legal power of the judicial decision”, proves that the invariability of the judicial decision is an element of the legal power of the judicial decision. The author selects the list of exceptions of the principle of the invariability of the judicial decisions, and the features of the invariability of some judicial decisions. The scientist also considers the problem of uncertain procedure of correction of arithmetic errors or slips, founded in the judicial order and gives the scientifically proved suggestions to solve this problem. | |
