Анотація
Стаття присвячена комплексному аналізу сфери впливу адміністративного права на банківську систему, кореляції взаємовпливів фінансового та адміністративного права щодо врегулювання владно-грошових відносин, пов’язаних з діяльністю комерційних банків, системи адміністративно-правових засобів регулювання діяльності комерційних банків. Особлива увага присвячена аналізу сукупності адміністративно-правових та діяльнісних інструментів, націлених на впорядкування комерційної банківської діяльності, зокрема правових норм, нормативно-правових актів, актів правозастосування, процесів і процедур дозвільного, контрольного, правовстановлюючого, карального та іншого характеру у банківській сфері. Констатовано, що публічне адміністрування досліджуваної сфери передбачає регламентування процедур валютних операцій, цифровізації цієї діяльності, технічного й іншого оснащення, встановлення обмежень й заборон у цій сфері, реалізації відповідних перевірок. Серед важливих сфер публічного адміністрування діяльності комерційних банків визнано прийняття правозастосовних актів, публічно-правових регламентів, обмежень, дозволів й заборон у цій сфері, зокрема щодо торгівлі валютними цінностями, здійснення грошових переказів, кредитування, розміщення депозитів клієнтів, ліцензування діяльності банківських установ. Визнано, що важливими інструментами адміністративно-правового впливу на сферу діяльності комерційних банків є діяльність щодо попередження, виявлення й припинення правопорушень й забезпечення законності у банківській сфері.
The article is devoted to a comprehensive analysis of the sphere of influence of administrative law on the banking system, the correlation of mutual influences of financial and administrative law on the regulation of power-money relations related to the activities of commercial banks, the system of administrative-legal means of regulating the activities of commercial banks. It is stated that the instruments of financial and administrative law are closely interconnected, complement each other, and make it possible to realize the maximum impact on ensuring the legality of the activities of commercial banks in Ukraine. Special attention is paid to the analysis of the set of administrative-legal and operational instruments aimed at regulating commercial banking activities, in particular legal norms, regulatory legal acts, law enforcement acts, processes and procedures of a permitting, control, law-establishing, punitive and other nature in the banking sector. It is stated that the public administration of the studied sphere involves the regulation of procedures for currency transactions, digitalization of this activity, technical and other equipment, the establishment of restrictions and prohibitions in this sphere, and the implementation of relevant inspections. Among the important spheres of public administration of the activities of commercial banks, the adoption of law-enforcement acts, public legal regulations, restrictions, permits and prohibitions in this sphere are recognized, in particular, regarding the trade in currency values, the implementation of money transfers, lending, placement of customer deposits, and licensing of banking institutions. It is recognized that important instruments of administrative and legal influence on the sphere of activity of commercial banks are activities to prevent, detect and stop violations and ensure legality in the banking sector. It was found that the administrative and legal means of regulating the activities of commercial banks in Ukraine are a set of administrative regulatory and operational instruments aimed at regulating commercial banking activities, in particular legal norms, regulatory and legal acts, law enforcement acts, processes and procedures of a permitting, control, law-making, punitive and other nature in the banking sector
