Анотація
У статті проаналізовано організацію діяльності публічної адміністрації в регіонах та на місцях з огляду на зарубіжний досвід. Досліджено не лише переваги, але й недоліки та ризики децентралізації, зазначивши, що вона не завжди дає змогу досягти бажаних результатів. Висвітлено, що, незважаючи на всі позитивні надбання та переваги процесу децентралізації в Європі, провідні вчені сучасності попереджають про необхідність відмови від його ідеалізованого уявлення. Запропоновано розглядати перспективність подальшого дослідження та наукового обґрунтування системи адміністративно-правових засобів удосконалення основних форм діяльності органів публічної адміністрації з урахуванням позитивного зарубіжного досвіду
A significant focus of activity at this stage of Ukraine’s development is the study and analysis of overseas experiences in public administration organisation. It should be borne in mind that Western countries have undergone lengthy and challenging reform processes in this area. As a result, they have developed valuable insights, which have been proven over time, regarding balanced standards of public relations management. In particular, there is a strong understanding of governance principles and the effectiveness of legal instruments to achieve optimal management results. Particular emphasis is placed on the concept of administrative decentralisation, which entails the delegation of competencies, obligations and financial resources from the central government to regional and local bodies with a view to the provision of public services (such as healthcare, education, social security and the provision of administrative services, to mention just a few examples). The concept of decentralisation is applicable to all forms of state sovereignty, albeit in varying forms and to differing extents. It is a defining characteristic of both federal and unitary states. The various European countries employ disparate models of decentralisation. The United Kingdom and Italy have implemented the devolution model as the most comprehensive decentralisation measure, affecting the legislature and its independence in certain matters. In contrast, Belgium and Germany have opted for a decentralised structure through the establishment of federal systems. Notwithstanding the elevated status of the regions, the nature of these states remains unitary. Concurrently, the overwhelming majority of unitary democratic countries in Europe are pursuing administrative decentralisation, which is defined by the transfer of powers and resources to regional and local authorities in a range of sectors, including education, healthcare, social services, environmental protection, transport, road construction, utilities, and so forth. The findings of numerous studies have demonstrated on numerous occasions that the decentralisation of decision-making authority results in the active involvement of local residents in decision-making processes. This is due to the fact that decentralisation reinforces democratic principles and the collaboration between the state and civil society, thus guaranteeing the comprehensive representation of diverse social and ethnic groups in the political sphere. Moreover, it can facilitate a more equitable distribution of resources or unify prosperous areas with less successful neighbouring areas under one local government. It can be stated that foreign experience in the organisation and operation of central and local public administration bodies of foreign countries demonstrates a clear trend towards decentralisation of public administration. This involves local governments receiving maximum autonomy and broad powers, which ensures their self-sufficiency in terms of organisation and finance. Nevertheless, in the majority of developed countries, decentralisation is typically accompanied by an enhanced oversight of central executive authorities over the activities of local governments, with the majority of disputes being resolved through the judicial system
