dc.description.abstractУ статті досліджено проблему особливостей природи та сутності правового забезпечення підвищення рівня валютної безпеки України в особливий період. Визначено, що наша держава, перебуваючи в епіцентрі складної геополітичної ситуації, змушена постійно оцінювати свій фінансовий стан і забезпечувати стійкість валютної сис­теми в умовах небезпеки. Доведено, що ключовим фактором урегулювання діяльності валютної сфери є належне та дієве валютне законодавство, відсутність якого не дає змоги реалізовувати конструктивну валютну політику та здійснювати дієвий валютний контроль, що останнім часом нерідко зумовлює безсистемність і зростання загроз безпеці валютній сфері. Запропоновано внести низку пропозицій до профільного закону для мінімізації більшості проблем, що стосуються валютної сфери. The article examines the problem of the peculiarities of the nature and essence of legal support for increasing the level of currency security in Ukraine in a special period. It is determined that our state, being in the epicenter of a difficult geopolitical situation, is forced to constantly assess its financial condition and ensure the stability of the currency system in conditions of danger. It is determined that the concept of currency security is multifaceted and complex, including various elements and directions of currency policy. With such a systemic approach, currency security is defined as a state of equilibrium and stability of the entire currency system of the state. The latter depends on what monetary policy the state pursues in general, and currency policy in particular. It is proven that the key factor in regulating the activities of the currency sphere is proper and effective currency legislation, the absence of which does not allow for the implementation of a constructive currency policy and the exercise of effective currency control, which in recent years has often led to a lack of system and an increase in threats to the security of the currency sphere. In conditions of martial law, assessing the level of currency security of Ukraine becomes not only relevant, but also extremely important for ensuring the stability and adaptation of the financial system. Military conflicts create a number of serious challenges for the currency system, in particular, an increase in defense spending, changes in trade relations, and general instability of the economic environment. Against the background of these challenges, the development and implementation of effective strategies for managing foreign exchange reserves becomes important; for this, it is necessary to apply comprehensive approaches to assessing the current state of the state's financial system. Building an effective mechanism for legal support of currency security requires determining the relevant requirements for it, and constant monitoring and control over the state of currency security is an important task of the central bank and other state administration bodies that have functions related to regulating the currency sphere. It is proposed to minimize most of the problems related to the currency sphere by introducing a number of proposals into the relevant law, in particular, to define the currency security of the state as an appropriate level of provision of the state with currency resources sufficient to perform its own functions, and the state of exchange rate formation, which maximally protects against external negative influences and creates favorable conditions for attracting foreign investment. Recent reforms and a general overview of the dynamics of the currency sphere do not give grounds for significant pessimism. The NBU and banks have managed to avoid a potential catastrophe in extremely difficult external conditions.
